The specifics on this myth are a little vague, so we are going to assume this is referring to concerns regarding the legality of EHR systems that are supplied to physicians from hospitals. Even though the Feds have published guidelines for allowing hospitals to cover up to 85% of the costs of EHR systems, the majority of hospitals and physicians do not consider this to be wise.

It has been our observation the so-called "safe harbors" to the Stark Anti-Trust Laws have often proven to be anything but safe for physicians, patients or hospitals. There has been a tendency for these arrangements to degenerate rather tragically. Based on recent surveys, the failure rate leading to deinstallation of the EHR is ranging somewhere between 20 and 40%.
